1. Acceptance of Terms
By accessing or using the HimoSoft Payment Gateway infrastructure, you agree to be bound by these Terms of Service. If you are using the service on behalf of an organization, you agree to these terms for that organization.
2. Service Description
HimoSoft provides a private payment routing infrastructure designed for high-throughput enterprise transactions. Our service includes API access, transaction monitoring, and multi-provider reconciliation.
3. Prohibited Use
You may not use HimoSoft for any illegal activities, including but not limited to money laundering, fraud, or processing transactions for prohibited goods and services. We reserve the right to terminate access immediately upon detection of suspicious activity.
4. Liability Limits
HimoSoft provides the infrastructure "as is." While we maintain 99.9% uptime, we are not liable for losses resulting from provider-side failures or incorrectly signed API requests from the merchant.
5. Refund Policy
No refunds are allowed or processed for transaction amounts under $2.00 USD (or equivalent in other currencies). For all eligible transactions, the original transaction charge/processing fee will be deducted directly from the refunded amount.
6. Chargebacks and Fraud
If we receive any fraud alerts or formal chargeback requests from provider networks or issuing banks, the affected transaction amount will be automatically and immediately refunded.
7. Cryptocurrency Processing & Transaction Discrepancies
All cryptocurrency routing transactions are processed in coordination with our integrated digital asset partner Nowpayments. Due to high asset volatility and the immutable nature of distributed ledgers, all crypto payments are finalized only after securing required blockchain network confirmations, and are strictly non-refundable.
Transaction Discrepancies: Any transaction discrepancies, including underpayments or overpayments made through cryptocurrency or any other currency channels, cannot be settled automatically. These instances require manual audit, review, and verification by our engineering teams. Such manual reconciliation processes may take up to 7 working days to resolve, with no guarantee of recovery for blockchain-based transfer losses.
Blockchain Node Validation & Liability: HimoSoft bears no responsibility or liability for cryptocurrency transfers that cannot be verified or validated by the respective global blockchain network nodes (e.g., due to network forks, extreme congestion, gas starvation, or incorrect address routing). We are not liable for any lost merchant or customer funds in these scenarios until the payment has been successfully settled and fully received in our designated infrastructure wallets.
8. Provider Compliance
Merchants agree to fully comply with all core policies and operating agreements established by our underlying global networks and upstream acquirers, including Stripe (for major card integrations) and EPS (for online banking and localized networks).
9. Governing Law
These Terms of Service and all platform merchant operations are governed by, interpreted, and enforced in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising out of these terms shall be resolved exclusively within the jurisdiction of the competent courts of Bangladesh.
10. Payment Method Availability & Regional Legality
All payment methods, channels, or processing options are not universally available to all customers, end-users, or jurisdictions. Cryptocurrency payment channels are strictly permitted only for users residing in regions where digital asset transactions are fully allowed under respective local and national laws. Furthermore, the availability of credit card networks, mobile banking (MFS), or alternative channels may be restricted, suspended, or dynamically disabled in your location based on partner gateway uptime, compliance limitations, or regional legal frameworks. Users and merchants are solely responsible for ensuring their transaction mechanisms fully comply with all applicable local regulations.
